12th Annual Savannah T.E.A.L.® Walk™

In consideration of being allowed to participate in any way in this particular competition, race, related events and/or activities (collectively, the "Event"), I, the undersigned, acknowledge, covenant and agree that:

I acknowledge that participating in Tell Every Amazing Lady About Ovarian Cancer Louisa M. McGregor Ovarian Cancer Foundation also known as T.E.A.L.® Walk/Run™ Program Event (Annual Savannah T.E.A.L.® Walk™) involves inherent risks of personal injury and loss of property. I understand that participation involves strenuous activity, which I am capable of undertaking, and that I have received no restrictions on such activity from any physician. I grant permission for first aid as deemed necessary to be provided to me on the premises or prior to transport to a hospital for further treatment. I hereby for myself, my heirs and my personal representatives assume any and all risks that might be associated with the event. I further waive, discharge, release, and covenant not to sue Tell Every Amazing Lady About Ovarian Cancer Louisa M. McGregor Ovarian Cancer Foundation also known as T.E.A.L.®, its officers, directors, organizers, employees, sponsors, volunteers, any individuals having any connection to the event, or other representatives or agents or their successors and assigns or the City of New York, the City of Savannah, or the owner of the site for the event, or their respective officers, directors, employees, or other representatives or agents or their successors and assigns, for any and all injuries, accidents, property losses, hazardous health conditions, or damages of any kind from present and future claims and liabilities of any kind, known or unknown, arising out of my participation in this event or related activities, even though such claim or liability may arise out of negligence or fault on the part of any of the foregoing persons or entities. 

Assumption of Risk. I AGREE THAT I HAVE TAKEN AN ACTIVE ROLE IN UNDERSTANDING AND ACCEPTING THE RISKS, CONDITIONS AND HAZARDS ASSOCIATED WITH THE EVENT AND AFTER THE OPPORTUNITY TO FULLY INFORM MYSELF ABOUT THE EVENT, I KNOWINGLY AND FREELY ASSUME AND ACCEPT ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, AND ASSUME FULL RESPONSIBILITY AND ALL RISKS FOR MY PARTICIPATION IN THE EVENT.

 I desire to participate in the event (The T.E.A.L® Walk/Run™ Program) being sponsored, conducted or arranged by Tell Every Amazing Lady About Ovarian Cancer Louisa M. McGregor Ovarian Cancer Foundation also known as T.E.A.L.®.  I understand that the event activities may include, but are not limited to, running, walking, exercising, dancing, biking, sitting on the ground, climbing, eating, meditation, or participation in online workshops, videos, or any other activities described in connection with the Event.  I also understand that the Event could be conducted partially virtually, meaning that, depending on the nature of the Event and ticket selection the participants will not meet at a specified location or locations, but will participate in the Event remotely, at locations of each participant's choice that have not been specified or inspected by T.E.A.L.®, with other participants who may agree among themselves to participate physically together, or participate online where appropriate to the event.  I further understand that T.E.A.L.® will not be providing supervision and will not have representatives present where the participants are located during the Event.

Release and Waiver. I hereby fully and forever release and discharge the Released Parties from, and expressly waive and covenant not to sue with respect to, any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that may arise from my participation in the Event.  I agree not to make or bring any such claims or demand against the Released Parties, and fully and forever release and discharge the Released Parties from liability under such claims or demands.

I UNDERSTAND THAT THIS RELEASE DISCHARGES THE RELEASED PARTIES FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST ANY OF THEM WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OR FAULT OF ANY OF THE RELEASED PARTIES OR OTHERWISE.

Insurance. I UNDERSTAND THAT T.E.A.L.® DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE IN THE EVENT OF MY INJURY, ILLNESS, OR DEATH, OR DAMAGE TO OR LOSS OF MY PROPERTY AS A RESULT OF MY PARTICIPATION IN THE EVENT.   

I would like to receive future emails from T.E.A.L.® in which I can opt out at any time.  I understand that I have a single opt-out option for all participating data partners including Elitefeats and Haku. 

Waiver & Release. I, for myself and on behalf of my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO SUE the organizers of the Event (the "Event Organizer"), Haku App Corporation, Inc., and/or EliteFeats and their officers, directors, representatives, officials, principals, agents and/or employees, subsidiaries, and/or assigns, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, volunteers, and if applicable, owners and lessors of the premises used to conduct the Event (collectively, the "Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, and/or loss or damage to person or property, incurred by me in connection with participation in the Event. I further agree to indemnify, defend and hold harmless Releasees from any loss, liability, cost, claim or damages arising from my participation in or association with activities and events organized and sponsored by the Event Organizer or connected with the Event. This release extends to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown.

Significant Hazard. I voluntarily agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual and/or significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest official.

In exchange for being allowed to participate in the Event and for other good and valuable consideration, which I acknowledge is sufficient and has been received, I hereby freely, voluntarily, and without duress agree to give this Release to T.E.A.L.®, its directors, officers, members, employees, volunteers and agents, all event sponsors and their employees, agents and representatives (the "Released Parties"), on behalf of myself, my heirs, administrators, executors, successors and assigns, and agree to the following terms:

Assumption of Risk. I am aware and understand that some or all of the Event activities may be inherently dangerous and may expose me to a variety of foreseen and unforeseen hazards and risks.  I acknowledge that I am voluntarily participating in the Event, and all activities it involves and have considered those risks. I hereby expressly and specifically assume such risks, including any and all risk of injury, harm, or loss that I may incur as a result of my participation in the Event or any of its activities.  I represent that I am capable of all activities involved in the Event and have received no restrictions on such activities from any physician or medical services advisor.  I understand and agree that there will be no supervision and I will be virtually walking on my own while assuming my own risk and I am liable for my own walk. I also understand that there will be no start or finish line provided since this is a virtual walk and I must be aware and responsible in choosing a safe place to participate in my own virtual walk. 

Training; Medical Insurance. I attest and verify that, unless otherwise indicated below, I am over 18 years of age, am free from all illnesses, injuries and defects that could interfere with my safe participation in the Event. I further attest that I am physically fit and sufficiently trained to participate in all activities associated with the Event and have not been advised otherwise by a qualified medical person. My participation in the Event is entirely voluntary. I am solely responsible for my safety and health while I train, prepare, condition and/or take any other actions or proactive measures of any kind in preparation for, or in anticipation of, the Event.

Minors Under The Age of 18. In the case that the participant of the above Release (the "Participant") is under the age of 18, I hereby certify, warrant and represent that I am the legal parent or guardian of said Participant. Furthermore, after fully informing myself regarding the nature and risks of the Event, I give my permission for Participant to participate in the same. Furthermore, I fully ratify, accept and agree to all of the terms of the above Release both for myself individually and as legal parent or guardian of the Participant.

 Release; No Compensation. I irrevocably grant unlimited permission to Releasees, to use, reproduce, sell and distribute any and all photographs, images, videotapes, motion pictures, recordings, or any other depiction of any kind of me or of my participation in the Event or related activity for any legitimate purpose in perpetuity and I understand that I shall not be entitled to any compensation therefore. Furthermore, I hereby irrevocably and absolutely grant permission to the Releasees to film, videotape and record gratis my performance in the Event and subsequently to telecast, sell, distribute and otherwise utilize the same in whatever manner Releasees shall deem appropriate. Such permission shall include granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me, to use, reproduce or broadcast, my name, nickname, image, likeness, voice, photograph, signature facsimile, and biographical information in connection with the Event without compensation of any kind to me. I acknowledge that Releasees and their representatives shall have the unlimited right throughout the world to copyright, use, reuse, publish, republish, broadcast and otherwise distribute depictions of or information about me and all or any portion of the Event in which I may appear on any and all radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter devised in perpetuity and without compensation to me. In consideration and in return for being allowed to participate in the Event, I release and agree not to sue the Releasees from all present and future claims regarding my participation in the Events that may be made by me, my family, estate heirs, or assigns.

ALL FEES, REGISTRATIONS AND DONATIONS ARE NON-REFUNDABLE.

Nor are they transferable from year to year or event to event. I understand that once I am signed up, event fees are used for event expenses and cannot be returned. I acknowledge that any registration fees paid, or donations made, in connection with the Event are non-refundable and may not be transferred to any other participant.

I understand that all participants must pay a registration fee.

Any Event activity giveaways are available only for those registered for the event with a ticket and attend in person activity on event date. No giveaways are available or eligible unless picked up in person on day of event. No items can be mailed to a participant. 

If signed by a parent, the parent agrees to release and hold the above-named organizations and persons harmless of any claims which may be asserted by or on behalf of the entrant as well.

General Provisions.  I hereby agree that this Release represents the full understanding between T.E.A.L.® and me concerning my participation in the Event and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, with respect to the subject matter hereof.  If any term or provision of this Release shall be held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions.  This Release is binding on and inures to the benefit of T.E.A.L.® and me and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. Section headings are for convenience of reference only and shall not define, modify, expand, or limit any of the terms of this Release.

Governing Law. I hereby agree that this Release is intended to be as broad and inclusive 

as permitted, and that this Release shall be governed by and interpreted in accordance with the laws of the State of New York, the State of Georgia, without reference to any choice of law doctrine.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 BY CLICKING HERE I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS WAIVER AND RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE T.E.A.L.® OR ANY OF THE RELEASED PARTIES.
