Mammoth Gran Fondo

2025 Mammoth Gran Fondo- ASSUMPTION OF RISK:                               

In consideration of the acceptance of my application for entry in the 2025 Mammoth Gran Fondo, including all rides associated with the event held on September 3-7, 2025, I hereby freely agree to and make the following contractual representations and agreements. I fully realize the dangers of participating in organized bicycle events and other cycling activities and I voluntarily assume all the risks associated with such participation. I understand that these risks include, by way of example and not limitation, the following: the dangers of collision with pedestrians, spectators, vehicles, other participants and fixed or moving objects; the dangers arising from surface hazards, equipment failure, inadequate safety equipment, and weather conditions; property damage or loss; and the possibility of serious physical injury, pain, mental trauma, or death.

For myself, my heirs, executors, administrators, legal representatives, assigns and successors in interest (collectively referred to as "successors" in this document), I release, forever discharge and agree not to sue the Sierra Cycle Series, Inc. the Sierra Cycle Foundation, the Eastside Velo Cycling Club, the Mammoth Mountain Community Foundation, the United States Forest Service, the State of California, the County of Mono, Los Angeles Department of Water and Power, United States Bureau of Land Management, Town of Mammoth Lakes, Mammoth Mountain Ski Area LLC, Alterra Mountain Company and it's affiliates, Footloose Sports, the Village at Mammoth, their respective employees, volunteer workers, agents, members, sponsors, promoters and promoting organizations, other participants, and all property owners, law enforcement agencies, public entities, and special districts (and their respective agents, officials, and employees) (collectively, the "Released Parties") through or by which cycling events and activities are conducted, from any and all liability, claims, loss, cost or expense, including, but not limited to, those arising from property damage or loss, injury to my body, mental trauma, or death, and waive any such claims against any such Released Parties, arising directly or indirectly from, or attributable in any legal way to, any negligence or other action or omission to act of any such Released Parties in connection with sponsorship, organization or conduct of any bicycle sporting event or activity, including the above named event, including travel to or from such event or activity, in which I may participate as a rider, club member, spectator, official, or volunteer. I hereby waive all such claims which I have now or may hereafter have against the above Released Parties, however caused. 

I agree it is my sole responsibility to be familiar with the event route, the California Vehicle Code, and any other applicable rules or special regulations for the above event and other cycling events and activities. I understand that the event is being held on roads open to vehicle traffic, and I agree to abide by all the laws in the California Vehicle Code and other applicable regulations. I understand and agree that situations may arise during this event which are beyond the control of the promoters and organizers, and I must continually ride so as neither endanger myself nor others. I accept responsibility for the condition and adequacy of my bicycle and related equipment. I will ride wearing an approved bicycle helmet that can protect against serious head injury, and assume all responsibility and liability for the selection of such helmet. I acknowledge that I am physically fit and able to compete in rigorous physical activities at high altitude.

If participating in the 102 Mile Gran Fondo, I understand that the cut off time, course closure and mandatory pick up from the Whitmore Rest Stop (approximately 91 miles into the course) is at 5:30pm local time. In the event I have not arrived at the Whitmore Rest Stop by 5:30pm local time, then I understand that I will be required to utilize event transportation back to The Village at Mammoth. 

I agree, for myself and my successors, that the above representations and agreements are contractually binding, and are not mere recitals, and shall bind me and my successors for the above event and all other events sanctioned or conducted by or through the Released Parties. I understand that I may be requested to sign additional agreements or releases prior to my participation in other such events or activities, and agree that my failure or refusal to sign such agreements or releases shall in no way affect the validity of this agreement nor revoke or cancel the terms of this agreement. I agree that should I or my successors assert any claim or bring any suit in violation of this agreement, I or any of my successors shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending against such claim or suit. This agreement may not be modified orally, and a waiver of any provision shall not be construed as a modification of any other provision herein or as a consent to any subsequent waiver or modification.  

I have carefully read this entry and release form and fully understand it's contents. I am aware this is a release of liability, a waiver of claims, an agreement not to sue and a contract between myself and the Released Parties and for the benefit of others described herein, and I sign it of my own free will. 

To the extent captured at and while participating in the above named event, I grant to the Released Parties (including agencies and contractors acting on their behalf) a worldwide, royalty-free, irrevocable, non-exclusive and sub-licensable right and license to reproduce, modify, publish and distribute my name, image, likeness and performance in any and all forms of media now known or hereafter devised, including online and in social media. I understand that nothing herein obligates any of the Released Parties to exercise any of the rights granted herein.
