I know that participating in a Yuengling Shamrock Marathon Weekend Event is a potentially hazardous activity. I should not enter and participate unless I am medically able and properly trained. I agree to abide by any decision of a race official relative to my ability to safely complete the run, however, I also acknowledge that race officials are not responsible to know my medical condition or my ability to participate in and complete this event. I assume all risks associated with participating in Shamrock Marathon Weekend activities including but not limited to falls; contact with other participants, volunteers and spectators; the effects of the weather, including high heat and/or humidity; traffic and the conditions of the road; and holes and obstructions along the route, all such risks being known and appreciated by me. I agree to medical treatment needed as determined by race medical personnel and waive the right to hold those personnel accountable for any adverse effects that should arise from said treatment.
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)'s recommendations for the prevention of the spread of epidemics, pandemics and infectious diseases.
I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties, as relevant and applicable in each instance: USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic Committee (USOC); the event directors, the host organization and the facility, venue and property owners or operators upon which the Event takes place; and any other organizers, promoters, sponsors, advertisers, coaches and officials for this Event; law enforcement agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance.
Having read this waiver and knowing these facts and in consideration of your accepting my application, I, for myself and anyone entitled to act in my behalf, waive release and hold harmless any and all race directors, officials, volunteers, and sponsors, including but not limited to, J&A Racing, Inc, City of Virginia Beach, State of Virginia, US Army, US Navy, and their representatives and successors from all claims of liabilities of any kind arising out of my participation in this event. I grant permission to all of the foregoing to use any photographs, motion pictures, recordings, or any other record of this event for any legitimate purpose (advertising, social media, digital, etc).
REGISTRATION RULES: There are absolutely NO refunds, even in the event of a race cancellation. No exceptions, not even for acts of God. Once we receive and accept your entry, you will NOT receive a refund. IF ATHLETE IS UNDER AGE 18: This is to certify that my son/daughter has my permission to compete in the Shamrock Marathon Weekend events and is in good physical condition. Race officials have my permission to authorize emergency treatment if necessary.
